WHY DO WE NEED YOUR EXPLICIT CONSENT TO USE THEM?
Judgment of the Grand Chamber of the Court of Justice of the European Union, of October 1, 2019, and Guide on the use of cookies by the AEPD, July 2020.
The judgment of the Grand Chamber of the Court of Justice of the European Union, of October 1, 2019, must be interpreted in the sense that consent is not validly given when the storage of information, or access to information already stored on the terminal equipment of a user of an internet website, through cookies is authorized by means of a checkbox marked by default from which the user has to remove the mark if they want to reject its use. In this sense, authorization must be based on explicit consent through an explicit acceptance check, a rejection check by the user, and a more information check of the exposed cookies.
This interpretation cannot vary depending on whether the information stored or consulted on the terminal of a user of an internet site consists or not of personal data.
The Grand Chamber of the Court of Justice of the European Union also provides in this judgment that the information that the service provider must provide to the user of an internet website must include the time that cookies will remain active and the possibility that third parties may access the information they store. This requirement is established by the version modified by Directive 2009/136, which modifies Article 5, paragraph 3, of Directive 2002/58/EU, and by the AEPD Guide of July 2020.
Regarding the possibility that the user can reject the use of cookies, it must be taken into account that if you reject or delete web browsing cookies, we will not be able to maintain your preferences, some page features will not be operational, we will not be able to offer you personalized services and each time you navigate our website we will have to request your authorization again for the use of cookies.
